1. About Atmos
Atmos is operated by Helm Sens AS, Norway (hereinafter "Atmos", "we", "us", or "our").

2. Acceptance of Terms
By downloading, installing, or using the Atmos iOS app or visiting the Atmos website at atmos.guide (collectively, "the Service"), you agree to be bound by these Terms of Service, our Privacy Policy, and our Cookie Policy. If you do not agree to any of these terms, please do not use the Service.
3. Description of Service
Atmos is an air quality and environmental health application that provides real-time air quality index data, weather conditions, UV index, pollen forecasts, personal exposure tracking, and indoor air quality estimates based on your environment and questionnaire responses, and daily weather and air quality push notifications (iOS, optional). The Service is available as an iOS app and as a web application.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify you of significant changes that affect your use of the Service.
4. Eligibility
You must be at least 13 years old to use Atmos in Norway. In other countries within the EU/EEA, the minimum age varies by jurisdiction (ranging from 13 to 16 years) in accordance with each country's implementation of GDPR Article 8. Outside the EU/EEA, you must be at least 13 years old, or the minimum age required by applicable law in your jurisdiction.
If you are under 18 years of age, you confirm that a parent or legal guardian has reviewed and consented to these Terms and to our processing of your personal data as described in our Privacy Policy. We may require verification of parental consent where required by applicable law.
5. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating an account and keep this information up to date. You may not share your account with others or create multiple accounts.
We reserve the right to suspend or terminate accounts that violate these Terms, are used fraudulently, or remain inactive for an extended period. We will provide reasonable notice before termination, except where immediate action is required to prevent harm or comply with legal obligations.
6. Health and Safety Disclaimer
Atmos provides air quality, weather, UV, pollen, and environmental health information for general informational purposes only. The data, estimates, and recommendations provided by Atmos:
- Are not medical advice and must not be used as a substitute for professional medical guidance, diagnosis, or treatment
- Are based on third-party data sources and computational models, and may not be fully accurate, complete, or up to date
- Should not be the sole basis for health, safety, or lifestyle decisions
- May not reflect actual local conditions in real time due to sensor coverage, data availability, or model limitations
If you have health concerns related to air quality, UV exposure, pollen, or any other environmental factor, consult a qualified medical professional. Do not disregard, delay, or avoid medical advice based on information provided by Atmos.
7. Data Accuracy and Third-Party Data
Air quality and weather data is sourced from third-party providers, including WAQI, YR (met.no), Open-Meteo, and OpenWeather. UV and pollen data may be sourced from additional third-party providers as indicated in the app.
We do not independently verify, and cannot guarantee, the accuracy, completeness, reliability, or timeliness of data from these sources. Indoor air quality estimates are calculated using a physics-based model combined with your questionnaire responses — they are approximations, not laboratory-grade measurements.
We make reasonable efforts to select reliable data sources and to present data accurately, but errors and interruptions in third-party data feeds are beyond our control.
8. Service Availability
We aim to provide a reliable Service, but do not guarantee uninterrupted or error-free availability. The Service may be temporarily unavailable due to:
- Scheduled or unscheduled maintenance
- Third-party API outages or data feed interruptions
- Technical failures, software updates, or infrastructure changes
- Circumstances beyond our reasonable control, including but not limited to natural disasters, power outages, telecommunications failures, cyberattacks, or government actions (force majeure)
We shall not be liable for any loss or inconvenience resulting from unavailability of the Service, whether planned or unplanned.
9. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation
- Attempt to reverse engineer, decompile, disassemble, or extract source code from the app
- Use automated tools, bots, or scripts to scrape, harvest, or access the Service at scale
- Interfere with or disrupt the integrity, security, or performance of the Service
- Attempt to gain unauthorized access to any part of the Service, other users' accounts, or our infrastructure
- Misrepresent your identity, age, or affiliation when using the Service
- Use the Service to collect, store, or process personal data of others without their consent
10. Your Data and Content
You retain ownership of any personal data and content you provide to Atmos, including questionnaire responses and preferences. By using the Service, you grant us a limited, non-exclusive license to process this data solely for the purpose of providing and improving the Service, as described in our Privacy Policy.
You may request export or deletion of your data at any time, as detailed in our Privacy Policy.
11. Intellectual Property
The Atmos name, logo, app design, visual identity, and all original content created by us are our intellectual property, protected under Norwegian and international copyright and trademark law. You may not copy, modify, distribute, or create derivative works based on any part of the Service without our explicit written permission.
Third-party data (including AQI readings, weather data, UV index, and pollen data) remains the property of the respective providers and is subject to their terms of use.
12. Third-Party Services
The Service relies on third-party APIs, data providers, and hosting services. We are not responsible for the availability, accuracy, or terms of these third-party services. Your use of features that interact with third-party services (e.g., location data sent to weather APIs) is also subject to those providers' respective terms and privacy policies.
Links to third-party websites or services within the app are provided for convenience and do not constitute endorsement. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Atmos and its owners, directors, employees, and contractors shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of data, revenue, profits, or business opportunities
- Any health decisions or outcomes based on data or information provided by the Service
- Any inaccuracy, delay, or interruption in data from third-party sources
- Any loss or damage arising from unauthorized access to or alteration of your data
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
Nothing in these Terms shall limit liability for damages caused by willful misconduct or gross negligence, or any other liability that cannot be excluded under Norwegian law.
14. Indemnification
You agree to indemnify and hold harmless Atmos and its owners, directors, employees, and contractors from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms, your misuse of the Service, or your violation of any applicable law or third-party right.
15. Termination
You may stop using the Service at any time. You may delete your account via the Profile tab in the app. Upon account deletion, your server-side data will be deleted in accordance with our Privacy Policy.
We reserve the right to suspend or terminate your access if you violate these Terms. Where reasonably practicable, we will provide notice and an opportunity to remedy the breach before termination. We may terminate access immediately where continued access poses a risk to the Service, other users, or third parties, or where required by law.
Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including Sections 6, 10, 13, 14, and 17) shall continue to apply.
16. Dispute Resolution
We encourage you to contact us first at breathe@atmos.guide to resolve any dispute informally. We will make a good-faith effort to resolve the matter within 30 days.
If a dispute cannot be resolved informally, it shall be subject to the exclusive jurisdiction of the courts of Oslo, Norway. These Terms are governed by and construed in accordance with the laws of Norway, without regard to conflict of law principles.
Nothing in this section limits your right to file a complaint with the Norwegian Consumer Authority (Forbrukertilsynet) or the Norwegian Data Protection Authority (Datatilsynet), or to exercise any rights you may have under mandatory consumer protection law.
17. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will:
- Update the "Last updated" date at the top of this page
- Notify you by email or in-app notification at least 14 days before the changes take effect
- Where required by law, obtain your renewed consent
If you do not agree to the updated Terms, you may stop using the Service and delete your account before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
18. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the original intent.
19. Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Atmos regarding your use of the Service, superseding any prior agreements or communications.
